1. Introduction
These Terms and Conditions govern the use of the Archir mobile application and the related online services (together, the "Application") operated by:
JL Arts s.r.o.
Registered office: Jana Harracha 129, 514 01 Jilemnice, Czech Republic
Company ID (IČO): 17594227
VAT ID: CZ17594227
Registered in the Commercial Register kept by the Regional Court in Hradec Králové, file no. C 50119
(hereinafter referred to as the "Provider").
By using the Application, the user confirms that they have read, understood, and agree to these Terms and Conditions.
2. Scope of the Service
Archir is a mobile application with related online services (cloud storage, processing, and account management). Its core is a unique guided capture system: the user takes photographs directly in the Application, precisely according to Archir's photography guidelines, with built-in checks that help ensure each space is captured correctly.
The user then sends the photographs for professional enhancement (retouching) and receives the final photographs in the Application. The Provider arranges and delivers this service, working with specialised creative partners (the "External Providers"), and is responsible for the technical operation of the Application as described in these Terms.
The Application is available for download free of charge. However, in order to process photographs through the Provider's system — including submission of retouching requests and storage of photographs — the user must maintain an active paid subscription.
3. User Account and Acceptable Use
The Application is intended for users aged 18 or older. By creating an account, the user confirms that they are at least 18 years old.
Each user is entitled to one user account only.
Login credentials are non-transferable, and the user is responsible for keeping them secure.
The user must not upload content that is unlawful or that infringes the rights of third parties, and must not use the Application to mislead others or for any unlawful purpose.
The user must not reverse engineer, copy, resell, or attempt to gain unauthorized access to the Application or its systems, or interfere with its operation or security.
The Provider reserves the right to restrict or suspend access to the Application in the event of a breach of these Terms.
4. Retouching Service
Retouching is delivered as part of the Archir service. The Provider carries it out with the help of External Providers it has contracted.
The user acknowledges that:
the Provider does not guarantee subjective or aesthetic quality of retouching,
retouching is a creative service and results may vary with the source photograph.
If a delivered photograph does not turn out as the user expected, the user may submit feedback directly from the photograph's detail screen in the Application. The Provider will then arrange one correction of that photograph at no additional cost (the "basic touch-up"). The basic touch-up covers adjustments of colour, light, tone, and blending of the existing image. To be processed as a basic touch-up, feedback must be submitted through the photograph's detail screen in the Application.
The basic touch-up does not change the content of the image. The Provider is not obliged to perform requests such as:
removing, adding, or replacing objects (e.g. "remove this car", "swap this tree", "remove this power outlet"),
cleaning or altering specific elements on request (e.g. "clean this window", "remove this reflection"),
sky replacement, virtual staging, or other custom creative edits.
Such custom edit requests fall outside the standard retouching service and, where offered at all, are subject to separate agreement, availability, and additional cost.
5. Copyright and Licensing
The user is the author and rights holder of all uploaded photographs.
The user represents and warrants that they have all necessary rights to upload the photographs and that no third-party rights are infringed.
The user grants the Provider a non-exclusive license, for the duration of the user's account and the retention period described in section 10, to:
store the photographs,
technically process them,
share them with the partners who carry out the retouching, solely for that purpose.
The Provider may use photographs to present and promote the Application (for example on its website, in presentations, and on social media), unless the user opts out at any time by contacting the Provider. All rights to retouched outputs transfer to the user upon full payment.
The Provider may also use photographs from which all personal data has been removed — that is, photographs that show no people, no personal belongings, and nothing else that could identify a person ("anonymized photographs") — without limitation to improve the Application and related systems, including developing and training automated tools and machine learning models, and to present and promote the product. Photographs are anonymized before they are used for these purposes.
6. Pricing, Subscription Plans, and Credits
The Application is available for download free of charge. To access photograph processing, post-production submission, technical support, and cloud storage features, the user must subscribe to one of the Provider's paid subscription plans.
In short: your subscription is what buys you access to the service itself — photo processing, submitting editing/retouching requests, photo export, and technical support. Credits are simply the usage allowance included in your tier (higher tiers include more credits) and are consumed automatically as photos are processed. Credits alone don't grant access: without an active subscription, any remaining credit balance can't be used and the app's core features are unavailable.
The user may choose from the following subscription plans, at the price shown in the Application and the Apple App Store at the time of purchase:
Starter – 250 credits per month (approx. 10 photos)
Agent – 750 credits per month (approx. 30 photos)
Studio – 2,000 credits per month (approx. 80 photos)
Enterprise – custom credit volume and pricing
Credits represent the unit of consumption within the Application. One retouched photograph requires approximately 25 credits.
Based on the amount paid for the selected plan, the user is granted an active subscription status for the corresponding billing period. An active subscription status entitles the user to:
photograph processing through the Provider's system,
submission and management of retouching requests,
cloud storage of photographs within the Application,
technical support for photograph-related issues and assistance with resolving any problems arising in connection with the use of the Application,
the number of credits allocated to the selected subscription plan, as shown in the Application at the time of purchase.
These entitlements are available only for as long as the user maintains an active subscription status. An available credit balance, whether newly allocated or carried over from a previous period, does not by itself grant access to photograph processing, retouching submission, cloud storage, or technical support — an active subscription status is required at all times to use these features.
6.1 Credit Allocation and Rollover
Upon successful payment for any subscription plan, all purchased credits are allocated to the user's account immediately and without delay.
Monthly plans: each recurring monthly payment results in the immediate addition of the full monthly credit allocation to the user's balance.
Annual plans: upon payment of the annual subscription, the user receives the full annual credit allocation in a single immediate grant. The next allocation occurs upon renewal after twelve (12) months.
Credits included in a subscription plan accumulate and do not expire as long as the user maintains an active paid subscription. Unused credits carry over into the next billing cycle and are added to any new credits allocated under the current plan.
Upon upgrading to a higher subscription tier, the user's existing credit balance is preserved in full. The new plan's credit allocation is added immediately, without any conversion or adjustment. The subscription plan and billing date are updated at the time of upgrade.
6.2 Credit Expiration Upon Cancellation
If the user cancels their subscription, they retain access to the Application and their credit balance until the end of the current paid billing period.
Upon expiration of the billing period following cancellation, the following apply:
all remaining credits are permanently deleted,
access to photograph processing, retouching submission, and cloud storage of photographs is terminated,
technical support provided under the active subscription is no longer available.
Credits are not refunded or transferred upon cancellation. If the user reactivates a subscription after the billing period has ended, their previous credit balance will not be restored. A new credit allocation begins with the new subscription.
6.3 Cooling-Off Period and Right of Withdrawal (EU/UK Users)
If the user is based in the United Kingdom or the European Union, the following cooling-off rights apply:
Subscription to the Service: the user may cancel within 14 days of signing up for a paid plan (or the free trial associated therewith) or upgrading their plan.
Any purchase of additional Credits, including additional credit purchases made through the Apple App Store: the user may cancel within 14 days of that purchase.
If the user cancels their subscription or purchase during the applicable Cooling-Off Period, the Provider will reimburse in full the applicable payment made. This does not apply to purchases made through the Apple App Store, which are refunded by Apple and not by the Provider — see section 6.6.
Important: If the user uses the Application in any way during the Cooling-Off Period — including by submitting a retouching request, applying any Credits, or otherwise making use of the Service — the user expressly agrees to waive their cancellation rights and will not be entitled to receive a full or partial refund of the applicable payment.
If the user signs up for a free trial, the relevant Cooling-Off Period commences on the date the free trial begins, not on the date the Provider charges the subscription fee. However, use of the Application for purposes permitted within the free trial (e.g., uploading photographs for evaluation and reviewing sample outputs) during the Cooling-Off Period does not result in the loss of cancellation and refund rights.
6.4 Additional Credit Purchases
Users with an active paid subscription may purchase additional credits beyond their plan allocation through the Apple App Store. The purchase of additional credits is only available to users who hold an active subscription at the time of purchase.
Additional credits are consumable and are allocated to the user's account immediately upon successful payment confirmation from the Apple App Store.
Additional credits are subject to the same accumulation and expiration rules as subscription credits:
Additional credits do not expire while an active paid subscription is maintained.
Upon cancellation of the subscription, additional credits are treated identically to subscription credits — they remain accessible until the end of the current paid billing period, after which they are permanently deleted.
Additional credits are non-refundable except as required by applicable law or Apple's refund policies. Refund requests for credit purchases must be directed to Apple in accordance with Apple's payment and refund policies.
The Provider has no control over and assumes no liability for refunds or disputes processed through the Apple App Store.
6.5 Free Trial
The Provider may offer a free trial, which includes one retouching cycle and a maximum of 50 photographs. The free trial is intended solely for evaluation purposes and does not create any entitlement to continued service.
Subscriptions and additional credits are purchased through the Apple App Store in accordance with Apple's payment and subscription policies. The Provider uses RevenueCat to manage subscriptions and verify your subscription status.
6.6 Automatic Renewal and Managing Your Subscription
Subscriptions purchased through the Apple App Store renew automatically:
Payment is charged to your Apple ID account at confirmation of purchase.
Your subscription renews automatically for the same period (monthly or annual) at the then-current price of your plan, unless you cancel at least 24 hours before the end of the current billing period.
Your Apple ID account is charged for the renewal within 24 hours before the end of the current billing period.
You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → your name → Subscriptions) on your device. Cancellation takes effect at the end of the current billing period.
Deleting the Application or deleting your Archir account does not cancel your subscription. To stop being charged, you must cancel the subscription in your Apple ID account settings.
If Apple notifies you of a price change, the new price applies from your next renewal; if you do not agree, cancel before the renewal date.
If a free trial is offered, it converts automatically into a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial period is forfeited when you purchase a subscription.
Requests for refunds of purchases made through the Apple App Store are handled by Apple (reportaproblem.apple.com), subject to Apple's refund policies and applicable law.
6.7 Apple App Store Terms
If you obtained the Application from the Apple App Store, the following also applies. Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") applies to your use of the Application in addition to these Terms.
These Terms are concluded between you and the Provider only, and not with Apple. The Provider, not Apple, is solely responsible for the Application and its content.
Apple has no obligation to provide any maintenance or support services for the Application.
The Provider, not Apple, is responsible for addressing any claims relating to the Application or your use of it, including product liability claims, claims that the Application fails to conform to legal or regulatory requirements, consumer protection claims, and claims of intellectual property infringement.
To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also comply with applicable third-party terms (for example, your wireless data service agreement) when using the Application.
7. Non-Payment and Service Restrictions
In the event of non-payment, the Provider may:
restrict Application functionality,
prevent the submission of new retouching requests,
suspend access to photograph storage and technical support.
Existing data remains stored for the retention period described in section 10.
8. Availability and Service Level
The Application is provided "as is". The Provider does not guarantee uptime or uninterrupted availability. Retouching delivery times are indicative only and not guaranteed. The Application is available for Apple iOS and requires a compatible iPhone, a supported version of iOS, and an internet connection; the user is responsible for any related data charges.
9. Liability
The Provider expressly disclaims liability for:
subjective or aesthetic quality of retouching,
loss of profit,
indirect or consequential damages.
The Provider's total liability is limited to the amount of the user's monthly subscription fee. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct, gross negligence, or death or personal injury.
10. Data Retention
User data is stored for the duration of the active subscription.
Upon termination of the service, data will be retained for 90 days, after which it will be permanently deleted, unless legal obligations require otherwise.
Users may request a data export prior to deletion.
Account deletion: users can delete their account at any time directly in the Application. Deleting an account is permanent and immediate: all data associated with the user, including photographs, retouching history, and any remaining credits, is deleted from the Provider's systems and cannot be recovered. Only records that the Provider is legally required to keep (for example, accounting records of payments) are retained for the legally required period. Deleting an account does not cancel an Apple App Store subscription — see section 6.6. No refund is issued for remaining credits or unused subscription time.
11. Termination
Users may terminate the service at any time by cancelling their subscription (see section 6.6) and, if they wish, deleting their account in the Application (see section 10).
The Provider may terminate or suspend access in the event of a breach of these Terms.
Termination does not affect rights or obligations accrued prior to termination.
12. Governing Law and Final Provisions
These Terms are governed by the laws of the Czech Republic.
Any disputes shall be resolved by the competent courts of the Czech Republic.
The Provider may amend these Terms. Material changes will be communicated in the Application or by email at least 30 days before they take effect. If the user does not agree with the changes, they may cancel their subscription before the changes take effect; continued use of the Application after that date constitutes acceptance. The current version is always available on the Provider's website.
Mandatory consumer protection provisions of the law of the user's country of residence remain unaffected.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full effect.
The Provider is not liable for failure or delay in performance caused by events beyond its reasonable control.
The user may not assign their rights or obligations under these Terms without the Provider's consent. The Provider may assign these Terms to a successor of its business.
