Terms and Conditions

(“T&C”)

1. Introduction

These Terms and Conditions govern the use of the software platform (the “Application”) operated by:

(hereinafter referred to as the “Provider”).

By using the Application, the user confirms that they have read, understood, and agree to these Terms and Conditions.

2. Scope of the Service

  1. The Provider offers an online SaaS (Software as a Service) platform designed for:

    • managing photographic workflows,

    • providing photography guidelines,

    • uploading and managing photographs,

    • submitting post-production (retouching) requests,

    • reviewing and approving final outputs.

  2. The service includes the facilitation of post-production services (retouching) provided by third parties (the “External Providers”).

  3. The Provider does not provide retouching or creative services and is solely responsible for the technical operation of the Application as a software platform.

3. User Account

  1. Each user is entitled to one user account only.

  2. Login credentials are non-transferable, and the user is responsible for keeping them secure.

  3. The Provider reserves the right to restrict or suspend access to the Application in the event of a breach of these Terms.

4. Retouching and External Providers

  1. Retouching services are delivered via External Providers contracted by the Provider.

  2. The identity of External Providers is not disclosed within these Terms.

  3. The user acknowledges that:

    • the Provider does not guarantee subjective or aesthetic quality of retouching,

    • retouching outputs are services delivered by third parties and facilitated through the Application.

5. Copyright and Licensing

  1. The user is the author and rights holder of all uploaded photographs.

  2. The user represents and warrants that they have all necessary rights to upload the photographs and that no third-party rights are infringed.

  3. The user grants the Provider a non-exclusive, limited-duration license to:

    • store the photographs,

    • technically process them,

    • transfer them to External Providers solely for retouching purposes.

  4. The Provider may use photographs for marketing and promotional purposes, unless the user expressly opts out.

  5. All rights to retouched outputs transfer to the user upon full payment.

6. Pricing, Subscription, and Free Trial

  1. The Application is provided under a monthly subscription model.

  2. The Provider may offer a free trial, which includes:

    • one retouching cycle,

    • a maximum of 50 photographs.

  3. The free trial is intended solely for evaluation purposes and does not create any entitlement to continued service.

  4. All payments are made directly to the Provider.

7. Non-Payment and Service Restrictions

  1. In the event of non-payment, the Provider may:

    • restrict Application functionality,

    • prevent the submission of new retouching requests.

  2. Limited access to existing data may remain available for a restricted period, depending on account status.

8. Availability and Service Level

  1. The Application is provided “as is”.

  2. The Provider does not guarantee uptime or uninterrupted availability.

  3. Retouching delivery times are indicative only and not guaranteed.

9. Liability

  1. The Provider expressly disclaims liability for:

    • subjective or aesthetic quality of retouching,

    • loss of profit,

    • indirect or consequential damages.

  2. The Provider’s total liability is limited to the amount of the user’s monthly subscription fee.

10. Data Retention

  1. User data is stored for the duration of the active subscription.

  2. Upon termination of the service, data will be retained for 90 days, after which it will be permanently deleted, unless legal obligations require otherwise.

  3. Users may request a data export prior to deletion.

11. Termination

  1. Users may terminate the service at any time in accordance with their subscription terms.

  2. The Provider may terminate or suspend access in the event of a breach of these Terms.

  3. Termination does not affect rights or obligations accrued prior to termination.

12. Governing Law and Final Provisions

  1. These Terms are governed by the laws of the Czech Republic.

  2. Any disputes shall be resolved by the competent courts of the Czech Republic.

  3. The Provider reserves the right to amend these Terms; the current version is always available on the Provider’s website.
